By the end of this workshop delegates

will be able to:

  • Determine whether legal liability attaches to some of the more common claims scenarios associated with this class of business
  • Understand the difference between legal liability and policy liability in the context of professional indemnity claims
  • Understand how legal liability can arise for the policyholder both within the context of a contract and where no contract exists
  • Adhere to claim procedures laid down in Civil Procedure rules
  • Understand those situations likely to give rise to claims against the policyholder that are covered under the PI policy
  • Be aware of the likely claimants including the impact of collateral warranties
  • The workshop will be centred around a number of claims case studies covering the following risks:
  • An insurance broker
  • An architect
  • An IT consultancy
  • A property surveyor

There will be a number of different scenarios for each and delegates will be encouraged to try to determine the extent of legal liability on the part of the policyholder and the degree to which the policy responds to each.

This course is highly participative and will encourage delegate participation at all stages through exercises arising from these case studies.
