Corporate Manslaughter for Insurance Brokers

This is an intermediate/advanced level, interactive  workshop, focusing on work related deaths, the implications for brokers and their clients and the risks of individual and corporate liability arising from such accidents.

The workshop is a half day session, delivered by a solicitor, featuring numerous exercises, with delegates working individually and in teams.

It is aimed at everyone (directors, underwriters, claims staff, etc) who is concerned about their firm’s and clients’ potential exposure.

•Be aware of the current legal position regarding corporate manslaughter


•Understand how the police and regulator think, their tactics and methodologies etc.
•Understand and apply the policy and coverage implications arising including conflicts of interest, representation of individuals
  and the possibility of gross negligence and/or corporate manslaughter offences being committed or prosecuted

•Develop an understanding of how the response of your client when an incident occurs can protect them from liability down the line

•Identify and analyse the steps that can be taken in advance by you and your clients to plan and prepare to control and manage a scenario in the event of an adverse incident within their business

•What constitutes Corporate Manslaughter? The current legal position in the UK


•The current law on inquests and representation of your clients for the Coroners and Magistrates Court


•How can you respond in the immediate aftermath of an accident?


•A step by step approach to the management of the police and HSE investigation and your clients’ management of risks arising, including:
•Internal and external investigations
•Use of experts
•Conflicts and Chinese walls
•Techniques for the insured when threatened with a police interview

•Tactical options to reduce exposure to liability
